Where do I register the restaurant?

Restaurants with and without an alcoholic beverage must be displayed at your local commercial or regulatory office. If the serving of alcoholic beverages is intended, the activity may not be commenced until a corresponding permit has been obtained. You can also apply for a restaurant permit at your local commercial or regulatory office.

Which documents are to be submitted?

As a rule, the following documents must be submitted as part of a commercial advertisement (restaurant MIT and OHNE Alkoholausschank):

  • Form for business registration
  • Identity card
  • For legal entities: Extract from the commercial register or register of associations
  • If notified by a representative: authority
  • Permission certificate, if applicable (not mandatory, but a prerequisite for taking up business)
  • Residence permit, if applicable (not obligatory, but if necessary a prerequisite for taking up business)

As a rule, the following documents must be submitted as part of a permit procedure (restaurant MIT Alkoholausschank):

  • Identity card
  • Documents relating to the building in which the restaurant is located: Site plan, floor plan and section drawing in duplicate
  • Building permit and final acceptance
  • Lease in copy; the gross lease must be recognisable
  • Information in tax matters from the tax office of the place where you have lived or operated a business in the last three years
  • Certificate of safety from the municipal tax office of the place where you have lived or operated a business in the last three years
  • Certificate of good conduct of document type O
  • Extract from the central business register of document type 9
  • Negative certificate from the insolvency court of those local courts in whose district you have had a place of residence or a commercial establishment in the last three years
  • Extract from the debtors’ register via the [Regional enforcement portal] (https://www.vollstreckungsportal.de/zponf/allg/welkommen.jsf) in accordance with Section 882b of the Code of Civil Procedure (ZPO)
  • Proof of information from the Chamber of Industry and Commerce (IHK) on the basic principles of food law
  • For legal entities: Extract from the commercial or association register or a copy of the partnership agreement or articles of association
  • If an application is submitted by a representative: authority
  • Residence permit, if applicable

The final restaurant permit is linked to space, type of operation and persons and can only be granted if you, as the applicant, are reliable. You can prove your reliability with the supporting documents listed above. The business department then checks whether the restaurant can be managed in the intended form.

Specifically, separate documents may still be required, which will be communicated to you by the competent body.
